Hit and Run Leaves Orange County Cyclist with Possible Brain Injury

Friday, September 10th, 2010

An Orange County bicyclist underwent treatment at a local hospital for head injuries after an August 28 hit and run accident. The Orange County Register reported that the accident happened near the corner of Seal Beach Boulevard and Bradbury Road, in the area around the Rossmoor Shopping Center. At the time of the report, the victim, a male in his mid-20s, was still under evaluation for trauma to the head.

A traumatic brain injury (TBI) can change the course of a life in an instant. This injury generally has three treatment phases. The first phase is acute treatment. Acute treatment encompasses the immediate treatment following the injury where medical personnel monitor and treat the swelling in the brain. The second phase is subacute treatment. Subacute treatment focuses on early rehabilitation through the patient’s release home or to a long-term care facility. The third phase is chronic treatment for which there are two categories: rehabilitation within the community and long-term consequences. The disabilities for patients with moderate to severe brain injury can last throughout life. Therefore, the patient, family and caregivers are all involved in the design and implementation of chronic TBI treatment.

Orange County Firefighter Suffers Catastrophic Injuries in Hit-and-Run

Wednesday, May 12th, 2010

An off-duty Orange County firefighter who suffered injuries described as “near catastrophic” when he was struck and nearly killed by a hit-and-run driver last December, has filed suit against Laguna Beach. On Dec. 5, 2009, the 38-year-old firefighter and paramedic was crossing South Coast Highway at Brooks Street in a marked crosswalk when a vehicle struck him and fled the scene. The force of the impact threw the man 50 feet and resulted in head trauma, internal injuries, broken bones and other injuries.

Witnesses told police that the vehicle was a white Toyota Corolla or Prius with California plates. As of April 2009, police had not yet found the hit-and-run driver or the vehicle involved in the accident. The former firefighter’s suit claims that the crosswalk at South Coast Highway and Brooks Street is dangerous due to inadequate lighting and lane marking and the crosswalk button, which were removed due to road construction on Coast Highway. He spent a week in the hospital for treatment and underwent surgical procedures to mend the broken bones, head trauma and internal injuries. Upon release from the hospital, he spent several more weeks in a wheelchair and graduated recently to crutches. It is not yet known if his injuries will prevent him from regaining the physical strength needed to perform the duties of a fireman and paramedic.

Police say that they are looking for a white Dodge van made in the 1980s “with a blue stripe running down the middle of the vehicle.”

Pedestrian v. Hit and Run Motor Vehicle – $240,000.00 Settlement

Friday, January 22nd, 2010

Attorney Samer Habbas resolved a pedestrian hit and run at the University of Southern California for $240,000.00.  Client was a pedestrian crossing in a cross-walk when he was struck by a vehicle.  The collision caused him to suffer a pelvic fracture.  The injury did not require surgery or physical therapy.  Although the hit and run driver was never located, Attorney Samer Habbas was able to resolve the claim for $240,00.00 with the client’s own insurance company under his Uninsured Motorist coverage.

This case shows the importance of carrying uninsured motorist coverage in the state of California.  Even though the client was not in a motor vehicle at the time, his uninsured motorist coverage still applied to pay for his damages.  Many individuals including this client did not have knowledge that uninsured/underinsured motorist coverage applied for pedestrian accidents.  Furthermore, it was beneficial to this client that he carried an uninsured motorist policy that had substantial limits, making it possible for him to achieve just settlement for his injuries regardless of the unknown identity of the driver that struck him.  If you are reading this, you should take the time to immediately check your own policy to see if you are protecting yourself and your family in the event that they are struck by an uninsured or underinsured driver.  Should you have any questions regarding your policy, please contact The Law Offices of Samer Habbas  and we will assist you in making sure you have the proper insurance coverage.
