Dog Bite Injuries

A recent WeHoNews.com story discussed the efforts of the United States Postal Service (USPS) to reduce dog bite injuries to its mail carriers. This story underlines the importance of understanding California’s laws regarding dog bite injuries and pet owner liability.

While some other states will not hold the owner liable for the first biting incident (the so-called “free bite” rule), this is not the case in California. California enforces a strict liability standard with regard to dog bites. This means that a dog owner is responsible for all injuries caused by his or her pet, regardless of dog’s breed or suspected temperament.

Dog bite injuries can be very serious. According to the Centers for Disease Control, one in five dog bites are serious enough to warrant significant medical attention. The dangers for young children are even greater. For them a dog bite is more likely to result in a trip to the emergency room.

Riverside County Motorcycle Accident Claims Wildomar Woman’s Life

MyDesert.com reports that a Wildomar woman has been killed in a Riverside County motorcycle accident. The accident occurred on Route 74 in Hemet when an SUV collided with a motorcycle driven by Diana Vandenberg of Wildomar. According to early police reports, Vandenberg was thrown from the motorcycle by the impact.

The motorcyclist was taken to Riverside County Regional Medical Center where she died several hours after the crash.

This accident highlights one of the tragic realities of riding a motorcycle on California’s highways-a motorcyclist is at greater risk of an accident on the roadways even if he or she does everything right. Other motorists often fail to notice motorcycles and turn in front of the smaller vehicles, fail to yield and otherwise trap the motorcyclist in dangerous situations.

Insurers and Businesses Brace for Swine Flu Related Claims

The swine flu is slowly spreading across America, and insurers and businesses are getting ready for the possibility of swine flu related premises liability lawsuits. According to a news release from Mondaq.com, some businesses may be more exposed to premises liability lawsuits in the event of swine flu than others.

Hospitality businesses-such as restaurants and hotels-may face lawsuits from customers and employees who become sick from swine flu after visiting an establishment. Certain businesses may also expose customers and employees to swine flu by the nature of their services, such as delivery services.  Of particular concern for businesses is the potential for one case to act as a gateway for several claims of exposure to the illness.

Ed McMahon Settles Medical Malpractice Suit

According to GantDaily.com, former television star Ed McMahon has reached a settlement in a medical malpractice suit against Cedars-Sinai Medical Center in Los Angeles. McMahon filed a medical malpractice lawsuit against the hospital claiming that in 2007 the staff at Cedars-Sinai had misdiagnosed a neck fracture he suffered. McMahon’s suit sought damages for the misdiagnoses as well as two allegedly botched surgeries following the diagnoses.

The article further mentions that McMahon is pursuing a personal injury lawsuit against the owner of the mansion where McMahon suffered the neck injury. According to the story, McMahon’s attorneys are filing an action in Superior Court to ban any mention of his Cedar-Sinai settlement in the injury lawsuit.

Fatal Bus Accident Caused By Driver Error

TheCalifornian.com released news that the California Highway Patrol has determined driver error as the cause of a bus accident that killed the driver and four French tourists on April 28, 2009.

According to the report, bus driver John Egnew failed to properly negotiate a curving section of Highway 101, causing the bus to strike one of the guardrails and flip on its side. The crash killed 5 and injured 32. California transportation officials cited in the news story said that the section of the road has not been a safety concern before. A California Highway Patrol investigator is quoted in the report suggesting that speed may have been an issue in the accident.
