AB2555 Would Help Prevent Nursing Home Neglect in California

California’s senior citizens living in nursing homes are extraordinarily vulnerable to many different types of nursing home neglect. Nursing home neglect can manifest itself in many ways, but one California lawmaker is hoping that the state’s Long Term Care Ombudsman program receives the funding it needs to keep protecting seniors living in nursing homes and assisted living facilities. The program trains state-certified volunteers who visit the state’s 1,300 nursing homes and over 8,000 assisted living facilities to look for signs of abuse and neglect.

Citing California’s notorious budget problems, Governor Schwarzenegger cut the program’s funding in half in 2008, which hampered efforts to help those who are not in a position to help themselves. The passing of AB 392 restored partial funding cuts that appropriated $1.6 million in funding from an account holding nursing home fines. However, that was a short-term solution, and if funding is not re-established, many of California’s seniors will be exposed to nursing home neglect. AB2555 is scheduled for a vote by lawmakers in the near future.

California Medi-Cal Funds Cut Nursing Homes Staff and Services, Endanger Residents

Covenant Care owns many nursing homes and skilled-care facilities that, along with other assisted living facilities, received $880 million in state funds in 2004 to provide better care for Medi-Cal patients. The money was provided so that these assisted living facilities could hire more staff, pay higher wages and provide a higher level of care for their patients. Non-profit newsroom California Watch conducted an investigation into the facilities that received this money and found that 232 of them cut staff and reduced nursing ratios below state minimum standards after receiving the funds.

Covenant Care’s marketing states that their facilities provide the “highest quality of care” and their staff treats the people under their care like “family.” California Watch singled out one of the company’s facilities for special mention. St. Edna Subacute & Rehabilitation Center in Santa Ana cut staff by 5 percent between 2004 and 2008, resulting in levels of care that fell below the state minimum of 3.2 hours per patient. St. Edna has reportedly received 119 citations and warnings for substandard care over the last three years. The state average is 54.

California Legislators Pass Nursing Home Quality of Care Measure

A recent California Chronicle article reports that California legislators passed a measure to confront the failing quality of care in California nursing homes. Measure AB 1457 passed on a vote of 77-0 in May 2009. The measure requires each licensee of a skilled nursing facility disclose with each abbreviated contract of admission and contract of admission, the name of the owner and licensee for the facility, along with the name and contact information of a single entity that is fully accountable for all aspects of patient care and the operation of the facility.

Assemblyman Mike Davis (D-Los Angeles)—author of AB 1457—said, “The California Legislature understands the special attention to the needs and problems of elderly persons, recognizing that these persons constitute a significant and identifiable segment of the population and that they are more subject to risks of abuse, neglect and abandonment, which makes them a disadvantaged class that have a particular need for assistance. AB 1457 provides California an opportunity to address a serious problem detailed in dozens of investigations by reports in the media. Each resident should know who is in charge of delivering services in every facility. This measure will require appropriate notification that will help to ensure quality care in nursing homes.”
