Car Accident: When Fault Lies With The Road, Not the Driver
Motor vehicle accidents are not always caused by the negligent or reckless driving of motorists. In some cases, the fault for the collision lies not with the motorists but with the road itself. Poor road design, construction or maintenance can make a road unreasonably dangerous. In these cases where the poor design, construction or maintenance of the road caused the accident, the municipal authority responsible for the road is liable to the victims of the accident.
The Legend of Dead Man’s Curve
One example of accidents caused by the defect in the road in the Los Angeles area is the infamous “Dead Man’s Curve” in Beverly Hills, which used to be located in the northern edge of the UCLA campus. In 1964, the pop tune “Dead Man’s Curve,” which chronicled a car race between teens that started in Hollywood at Sunset Boulevard and Vine Street and tragically ended somewhere west of Doheny Drive, became a national hit. Although this song had national popularity, it had first been notorious locally.
Sunset Boulevard, just north of the UCLA campus, was known for being particularly dangerous for eastbound traffic because of running downhill and bending sharply left. This made it easy for a car to accelerate above the posted 35-mph speed limit. This dangerous curve was not sufficiently banked to prevent cars from veering right into a wall of trees, which allowed cars to overcorrect to the left and spin out or swerve into oncoming traffic.
The dangers of this stretch of road was brought to the attention of the City of Los Angeles when the most famous victim of Dead Man’s Curve, Mel Blanc (the actor who was the voice for Looney Tunes characters) was involved in a catastrophic head-on collision, which left him with multiple fractures, head trauma and in a body cast for seven months. Blanc filed a $500,000 lawsuit against the City. The suit cited three fatal accidents and a total of 26 accidents at Dead Man’s Curve in a two-year period. As a result of this lawsuit, the City of Los Angeles allocated funds to restructure the curves along this section of the road.
Although Dead Man’s Curve is now a thing of the past, there are other stretches of the road in the Los Angeles area that are dangerous and have caused many devastating and fatal accidents. If you or a loved one has been involved in an accident that you believe may have been caused by the poor design, construction or maintenance of the road, it is imperative to immediately consult with an experienced road design accident attorney to protect your legal rights.
