The Complexities of California Wrongful Death Laws
In wrongful death cases, the only people who may file a claim are, in order, the decedent’s:
- Surviving spouse
- Children of deceased siblings
- Lineal descendants
The survivors listed above can file claims either separately or jointly. If these claimants do not exist, then the following relatives of the decedent can file wrongful death claims, in order:
- Common law, or putative spouse
- Children of the putative spouse
As you can see, there is a definite order of who may file a claim. It’s important to note that awarded damages usually go to a surviving spouse and/or children. Someone who was financially dependent on the decedent would receive damages before others. In addition, the chain of people eligible to receive damages is different if the decedent is a minor. California wrongful death laws also clearly define the types of damages that survivors can recover in wrongful death litigation. These damages include the following:
- Financial support the decedent would have provided
- The value of future household services the decedent would have provided
- The loss of love, support, comfort, companionship, affection and consortium (spouse only)
