Slip and Fall Incident Caused by a DogSan Juan Capistrano, Calif. — Managing Partner, Samer Habbas of the Law Offices of Samer Habbas & Associates, achieves a $225,000 settlement for a slip and fall accident that was caused by a dog. The plaintiff was visiting a friend’s residence for the first time, in which she received an unwelcome greeting by her friend’s dog. Upon entering her friend’s home, the dog began to bark and lunge towards her. As defense, the plaintiff backed up in reaction to the dog’s aggressive approach. Her protective reflex caused her to fall down a discreet step behind her. 

The plaintiff immediately sought medical attention with complaints of ankle pain, deformity and swollenness. She was then diagnosed with a trimalleolar fracture of her right ankle and oblique fracture of the fibula, in which she was fitted with an ankle splint. Weeks later, she presented to a medical center for severe pain, where she was diagnosed with a displaced trimalleolar fracture of her right lower leg. After thorough examination, she underwent surgery to stabilize and heal her ankle. 

As a result of the accident, our client’s quality of life has taken a major toll. She has had to make many sacrifices regarding her daily activities. Habbas and our legal team promptly filed suit against the homeowner’s insurance for failure of managing their premises, to prevent any foreseeable risks of danger to visitors. The insurance company responded with a low-ball offer that was inferior to what our client deserved. With Habbas’ tenacity and compelling argument points, he was able to raise the settlement $100,000 over their initial counteroffer; a total of $225,000 for our client’s case.
