These revelations are coming forth after CNN reviewed numerous medical records and court filings.One of the victims was visiting the park to celebrate her 16-year-old daughter’s birthday. She repeatedly struck her head against the headrest, which caused a tremendous brain swelling.Surgeons actually had to remove part of her skull to relieve some of the swelling. Sadly, she was still on a ventilator and in a coma as of August 2026. For its part, Six Flags has said that the ride is currently closed as they investigate.Liability for Roller Coaster Injuries at Six Flags Magic MountainTheme park operators have a legal obligation to maintain their premises in a reasonably safe condition to prevent foreseeable sources of harm. Pursuant to California Civil Code 1714, \u201cEveryone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.\u201d Moreover, California Civil Code 2100 requires that amusement park operators use the utmost care and diligence to ensure the safety of their guests.
