- In insurance
If you were seriously injured in a car accident caused by another driver who has little or no car insurance, you could be stuck without a way of getting compensation for your injuries – unless you have underinsured (UIM) coverage or uninsured (UM) coverage. These two types of insurance coverage’s allow you to get compensated from your own insurance company, up to the limits you have purchased.
However, just because you have UM or UIM coverage, it does not mean that it will be easy to collect from your insurance company. In fact, in most cases it is more difficult and frustrating to get full compensation from your own insurance than the insurance company of the at-fault driver.
California Underinsured and Uninsured Drivers
California car accidents can result in serious injuries with thousands of dollars in medical bills. Although your best option is to file a claim against the party who caused the accident, it may not always be a means to the end. In some cases, the at-fault driver may not have adequate insurance coverage to compensate you for your injuries.
California requires motorists to have a minimum coverage of $15,000 in liability for bodily injury or death of one person and $30,000 for more than one person. In some cases, the driver who hit you may have no insurance at all, even though California law requires all drivers to be insured.
Using Your Own UIM/UM Insurance Coverage
If you find yourself injured in an accident with an at-fault driver who has little or no insurance coverage, you will need to find an alternative source for compensation. This is when your UIM or UM insurance comes into play. It is important to note that this coverage is optional. This means that you have to specifically ask to purchase this coverage as part of your policy.
If you have purchased UM or UIM coverage from your own insurance company, you can use it to pay monetary compensation if you are hit by a driver with no insurance or a small policy that will not cover your costs relating from the accident.
