MADERA, CALIFORNIA (February 23, 2024) – Eight people have tragically died in a Madera head-on collision between a van carrying farmworkers and a pickup truck on Avenue 7.
The truck collided with a van carrying farmworkers headed to Lion Farms. Firefighters and paramedics were called to the scene in order to help all of the victims.
In all, 7 people in the van lost their lives in the crash. Three of the victims were residents of Mexico and were identified as Juvenal Talavera, 24, Hector Orozco, 34, and Alfredo Sanchez.
One person in the van survived the crash with major injuries. All the passengers in the van lived in Kerman. Officers said that one person in the pickup truck also died.
The California Highway Patrol told reporters that they received calls about a pickup truck swerving all over the road before the crash. It remains unclear if drugs or alcohol may have played a role in the crash.
A full investigation remains ongoing at this time.
Driver intoxication remains one of the leading causes of car accidents in the United States. According to the Centers for Disease Control, “In 2020, 11,654 people were killed in motor vehicle crashes involving alcohol-impaired drivers, accounting for 30% of all traffic-related deaths in the United States. If a driver crosses into opposing lanes of traffic, they will typically be held at fault in the event of a crash. Pursuant to California Vehicle Code 21651(b), it is unlawful to drive any vehicle upon a highway, except to the right of an intermittent barrier.
If a worker is injured on the job, their family will typically have recourse through worker’s compensation. In California, worker’s compensation operates through a no-fault insurance scheme. There is no need for an injured worker or their family to demonstrate that one party was at fault in order to receive benefits. The family of a deceased worker may also have recourse through a third-party liability claim.

If a pickup truck was being used for commercial purposes, that company could potentially be liable. In general, employers are liable for the wrongful acts of their employees, insofar as those employees were working within the course of their job duties.
