What If I Am A Phantom Driver?

Not many people have heard of a phantom driver. You may wonder what exactly a phantom driver is and if you have ever been one. You may have been a phantom driver without ever knowing. But what are you supposed to do if you’ve later realized that you were a phantom driver?

If you or a loved one has been impacted and involved in a car accident with a phantom driver, call Law Offices of Samer Habbas & Associates at 888-848-5084 or contact us online.

What Is A Phantom Driver?

A phantom driver is a driver who causes a car accident without actually making contact with another vehicle. As an example, they may be distracted and drift into your lane of traffic without even knowing. They may cause you to go off the road to avoid them or cause you to hit a car, all while the phantom driver escapes unharmed.

Can You Seek Compensation?

Even if there are no injuries involved in the accident, it is not impossible to receive compensation from the phantom driver. However, this process is more complicated. An experienced attorney may be able to help you track down the phantom driver using evidence that is left at the scene. In today’s world, there are additional cameras on gas stations, office buildings, and even street posts. If you can log where and when your accident with a phantom driver happens, your attorney may be able to track down enough information to find the driver and hold them liable for the injuries they have caused.

Uninsured Motorist Coverage

Even if your attorney is unable to track down the phantom driver,  you may still be able to receive some compensation for an accident caused by a phantom driver. In California, a phantom driver accident is typically covered by uninsured motorist coverage (UIM) on your own auto insurance.

One of the major downsides to this type of coverage is that it might not cover all of your damages, and you will still need to provide specific evidence to the insurance company. Your attorney will be able to help you create and submit the appropriate documentation to make sure you can still be compensated under your own UIM policy on your car insurance.

Proving Your Accident

You may have to show that a phantom driver caused your accident to receive coverage. The insurance companies will usually require you to provide evidence by either providing eyewitness testimony about the accident or showing the physical damage caused to your car. Many insurance companies will look for ways to avoid paying the accident claim. If you are seeking to have your UIM coverage pay out some of your damages, the evidence that you provide will need to be as strong as possible.

To prove your accident, you’ll need to make sure you have lots of evidence and proof of the accident to provide. With all of the moving pieces of a claim, you will want to be sure you keep track of all of the evidence you have from the accident.
