ENCINITAS, CALIFORNIA (August 17, 2026) – At least 12 people were hospitalized after a tour bus collision on the southbound lanes of Interstate 5 near Encinitas.
California Highway Patrol is saying that the crash occurred around 5:24 PM on Monday, August 10. A green tour bus was headed down the road when it hit the back of a semi-truck.
Multiple paramedics and first responders were called to the scene of the collision to help all of the victims. One photo of the accident site showed major front-end damage to the bus involved.
At least 12 people were taken to local area hospitals. Multiple others were treated at the scene.
It remains unclear if the bus driver will face any citations for the crash.
Liability for Encinitas Semi-Truck Accidents
California law requires that common carriers operate with an abundance of caution to avoid causing harm to their passengers. According to Acosta v. Southern California Rapid Transit Dist., “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a very cautious person towards their passengers. Such carriers are responsible for any,even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.” There are many ways that a bus driver may have acted negligently prior to any collision.
Under California law, drivers are required to maintain adequate separation with other vehicles ahead of them. Pursuant to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” Liability for any bus collision could extend beyond any one driver determined to be at fault. The company that a bus driver worked for could be vicariously liable if the bus was being used for some type of commercial purpose at the time of the crash.
Buses are typically very safe for their passengers. But bus accidents can still result in very serious injuries or death if the vehicles involved are traveling at freeway speeds. According to The Journalist’s Resource, “about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.
