Car accidents remain a leading cause of preventable injury and death in the United States. According to the Centers for Disease Control, “In 2022, almost 44,000 people died in motor vehicle crashes in the United States. That is more than 120 people killed in crashes every day. There were over 2.6 million emergency department visits for injuries from motor vehicle crashes in 2022.” Car accidents are largely preventable and due to numerous preventable errors.
All drivers have a legal obligation to operate their vehicle with an abundance of caution to avoid collisions. Many traffic accidents involve one driver who crossed into opposing lanes of traffic. Pursuant to California Vehicle Code 21651, it is unlawful for any person to drive their vehicle upon a highway, except to the right of an intermittent barrier or diving section. There is a presumption of negligence on the part of any driver that crosses into opposing lanes of traffic and collides with another vehicle.
It is possible that there could be numerous sources of negligence for any accident. This is particularly true if an accident involves one vehicle where the roof crushes in. Vehicle manufacturers have a legal obligation to take certain steps to protect vehicle roofs from being crushed. According to Federal Motor Vehicle Safety Standard No. 216, vehicle roof structures must be designed to withstand a certain amount of deforming force likely to result in the roof caving in. If a car roof caves in and injures vehicle occupants, this may form the basis of a strict product liability claim.
A number of different lawsuits have been filed by people injured as a direct result of vehicle roofs being crushed during an accident. In particular, Ford was hit with a $2.5 billion verdict in Georgia after numerous people sustained injuries in roof crush accidents. The lawsuit targeted the company’s “Super Duty” trucks. Attorneys for the plaintiffs argued that the roof had an inefficient strength-to-weight ratio. It is important that several steps are taken after any car accident.
Car accidents are often highly complex events. The factors that contribute to any accident could take place hours, days, or weeks beforehand. These incidents may involve multiple liable parties. Victims of car accidents tend to suffer very serious consequences, both medically and financially. It is common for victims to be burdened with high medical bills and lingering injuries. This is why it is so critical that any person injured in a San Bernardino County car accident seek the guidance of an experienced personal injury attorney.
