Wrongful Death

Man Dies After Assault Outside Newport Beach Nightclub

A 27-year-old Corona del Mar man who was assaulted outside a Newport Beach nightclub early Thanksgiving morning died from his injuries after his family took the man off life support. Police say the assault took place around 1:40 a.m. on Thanksgiving morning as he was leaving Code Restaurant/Lounge at 4221 Striker Way. Witnesses saw the victim confronted by a man in the parking lot and said the man punched the victim hard in the face, the force of which caused an artery to burst in the victim’s brain.

The victim was taken to Western Medical Center in Santa Ana where he was declared brain dead. The victim’s family kept the man on life support until the following evening so that his organs could be donated. More than one hundred of the victim’s family and friends came to the hospital on Thanksgiving Day to pay their respects. The victim’s family and police are asking the public for help in identifying the attacker. Police did not know of any motive for the attack.

There are many different crimes that can be classified as wrongful death, and this attack that caused fatal injuries is a textbook example. Whether or not the attacker intended to kill his victim is irrelevant to the fact that his actions resulted in the death of another person.
