Leashing Dogs: L.A. Law

Tuesday, March 8th, 2011

The County of Los Angeles has codified dog leash laws into its legal books. The L.A. County Department of Animal Care and Control specifies that dogs that are off the premises of their owners must be on a leash at all times. This broad ruling refers to all breeds of dogs whether they are dangerous or non-dangerous as well as all public situations.

L.A.’s Title 10 Section 10.32.010 states that no one who “owns or has charge of a dog” can let the animal “run at large.” That means leashing is a hard and fast requirement. Some dog owners apparently haven’t received the memo, some asking about leash laws on dog forums and others still allowing their dogs to roam in public areas.

Other provisions of the same Los Angeles legal codes specify other potentially dangerous situations that dog owners must avoid. For example, drivers can’t legally put a dog in the open back of a truck or similar vehicle. This part of the law relates to the same types of dangers as the overall leash law, meaning dogs that get out of the backs of vehicles can easily injure bystanders before owners have time to control them.

Fatal Dog Bite Case Illustrates Need for Enforcement

Thursday, February 17th, 2011

Dog bite cases continue to plague Orange County residents. They are often related to special “attack breeds” of dogs such as pit bulls. Home insurance estimates show that pit bulls are a popular breed in Orange County and other areas of Southern California. Although these breeds can be competent guard dogs, some tragic cases underscore the need for additional safety measures.

KTLA, a local news venue reporting events out of Orange County and adjacent regions, has identified a recent case involving a homeowner mauled to death by two pit bull dogs. In this case, the woman had been in the process of moving out of her home when the fatal attack occurred. The two dogs involved in the mauling had gained access to her property through a fence, according to official reports.

This kind of case shows that the owners of pit bulls and similar breeds need to provide special care and consideration to protect their neighbors. The California Civil Code 3342.5 demonstrates the responsibilities of dog owners under stringent local laws designed to protect the population. Many dog owners are aware of the laws that apply to them, and they observe them. However, there are numerous others who disregard their responsibilities and instead choose to endanger the people around them.

Trespass and California Dog Bite Cases

Thursday, January 20th, 2011

Many Californians suffer dog bites each year. Dog bites are responsible for some very severe injuries and trauma to victims of all ages throughout the state of California. In response to this, the state has formulated some specific legal codes for dog bite cases of which everyone should be aware.

Some of the limitations of a dog bite case may not be evident to those who are unfortunate enough to encounter a dangerous animal. Within the state law for dog bite injuries, trespass is one of the most relevant aspects of a dog bite case.

Current readings of the California state law look at trespass as a defense in a dog bite lawsuit. This means that if a dog owner can show that the victim entered his or her property despite clearly posted warnings, the victim may not be entitled to the same awards or be eligible for the same kinds of settlements. One way for Californians to deal with this is to educate both adults and children about the seriousness of trespassing. In cases where trespass may be a vague factor, victims can also turn to professional personal injury lawyers to seek resolution in a complicated dog bite case.

This and other statutes of limitation are extremely important in a California dog bite case. If a dangerous dog has injured you, call our California dog bite lawyer, Samer Habbas. Dog Bites Two in Riverside

Thursday, January 6th, 2011

A recent Southern California dog bite accident shows just how dangerous canine pets can be when owners do not take proper care of them and prevent them from exhibiting aggressive behavior toward those who encounter them.

A December 23 report shows that a young girl in Riverside sustained injuries when a bulldog mix bit her in the face. The dog is one of two in a local home. Officials indicated the animals also bit an adult during the same incident. Reports suggest the animals in question were not fixed and that hormonal changes may have been partially responsible for the incident. In addition, the dogs allegedly lacked current vaccinations and do not have proper licenses.

KTLA News in Los Angeles reported that the two dogs have been euthanized since the incident. Dog bite cases like this show that serious injuries can result when dangerous dogs come in contact with visitors to a home or other individuals who are not accustomed to their aggressive behaviors.

Dog bites can be traumatic, and medical treatment can be costly, possibly involving extensive cosmetic surgery necessary to correct visual damage. Victims of dog bites in Southern California may rely on professional legal assistance to pursue the compensation they need to cover the costs of medical bills, lost wages and other related expenses as well as pain and suffering.

Two-Year-Old Child Fatally Attacked by Three Pit Bulls

Friday, August 13th, 2010

The majority of severe dog bite attacks that occur each year in the United States have victims who are under the age of five. Virtually all Los Angeles personal injury lawyers would tell you this statistic is due to the fact that younger children often do not fully understand the situation and can be somewhat more trusting or act uneasy around dogs. It is very important to always make sure that parents supervise young children when they are around unfamiliar dogs and other animals.

Recently in the Los Angeles area, three pit bulls fatally attacked a two-year-old. The child ventured off into a garage where the dogs were, and the animals attacked. Law enforcement officials euthanized the three dogs involved in the mauling. Over the last few years, there have been multiple reports of pit bull attacks in the Southern California area, and multiple pit bull owners had to put down their dogs. Not all pit bulls are prone to attack, but these dogs are an aggressive breed. However, unlike many other states, California does not allow the banning of specific dog breeds.
