Liability for Windsor Pedestrian Accidents
Drivers must continuously scan the road ahead of them and slow down to avoid hitting any pedestrian in the roadway. Pursuant to California Vehicle Code 21954, drivers must exercise care to avoid colliding with any pedestrian in a marked crosswalk. A driver’s duty of care to avoid colliding with a pedestrian does not disappear even in situations where the pedestrian is outside of a marked crosswalk. Multiple factors could contribute to a pedestrian collision.
- Speed: Drivers are substantially more likely to hit pedestrians when they are speeding. Even traveling the speed limit could be considered dangerous depending on the prevailing road conditions.
- Obstructed View: Many pedestrian collisions occur because a driver’s view of the roadway is obstructed. For example, a car stopped at an intersection may block the view of a nearby pedestrian already crossing the street.
- Fatigue: Driver fatigue is substantially more dangerous than many people realize. The Centers for Disease Control estimates that staying awake for only 17 hours can impair a person’s ability to operate their vehicle safely equal to driving with a blood alcohol concentration of 0.05%.
- Inclement Weather: Poor weather conditions are another major cause of car accidents. Rain, snow, and fog can make it more difficult for drivers to see pedestrians crossing the road.
The vast majority of pedestrian accidents are completely preventable. They tend to involve drivers that are not properly scanning the road ahead of them. California is one of many states that adjudicates claims on the basis of comparative negligence.
Even if a pedestrian was partially at fault for a collision, they will normally still be able to recover damages through a civil claim.
Third-Party Liability for Pedestrian Accidents
Often there could be several liable parties for any pedestrian collision. According to the Federal Motor Carrier Safety Administration, “Motor vehicle crashes are complex events. Usually they involve two or more vehicles. Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” What follows are a few of the parties that could be liable for a pedestrian crash.
- Additional Drivers: It is possible that more than one driver could be liable for a pedestrian collision. For example, a vehicle may have been pushed into a pedestrian after being rear-ended.
- Rideshare Services: A rideshare service like Uber or Lyft could be liable for a collision if they allowed a driver to work on their platform who had a revoked license or was not otherwise eligible to work.
- Employers: If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. Pickup trucks and vans are commonly used for commercial purposes.
- Municipal Entities: When a pedestrian accident was caused by a dangerous condition on public property, the municipal entity responsible for the road could be held at fault. For example, a city may have allowed foliage to obstruct a stop sign.
It is important that victims of pedestrian accidents understand that they do have legal rights. They are able to seek damages through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are. There are no up-front costs associated with hiring an attorney, and they only get paid by the opposing party if they are able to resolve your case.
