Liability For Westchester Bowling Alley Assaults

Los Angeles County has a disproportionately high rate of violent and non-violent crime compared with other counties in California. According to USA Today, Los Angeles experienced an 11% increase in its overall rate of crime in 2022. Around 60 residents out of every 1000 reported being the victim of crime. This includes both instances of violent and non-violent criminal activity. In particular, gang-related violence accounted for 43% of homicides in Los Angeles County. There are steps that businesses can take to help prevent violent crime on their premises.

  • Property owners should ensure that all areas of their business including parking lots are well illuminated.
  • Property owners may need to hire security guards depending on the nature of their business.
  • Property owner should install cameras throughout their premises.

Property owners in California have a legal obligation to maintain their premises in a reasonably safe condition. Pursuant to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person.” A business owner can be liable if a guest is injured by criminal activity that is reasonably foreseeable. Whether or not any instance of crime is foreseeable can depend on a number of factors including previous instances of criminal activity at a certain location. There are a number of steps that should be taken after assaults at a business.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • An experienced premises liability attorney should be consulted.

Assaults can be extremely difficult for even the toughest people to deal with. Even after a person’s physical injuries have healed, assault victims often suffer from long-term psychological injuries. Any person that is injured at a business may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that stem from violent assaults. It is important that all evidence is properly preserved after any incident.
