Liability for Arcadia Bus Accidents
Buses can be very dangerous for pedestrians and those in smaller vehicles. According to The Journalist’s Resource, “on average, about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” There are a number of factors that could contribute to any bus accident.
- A bus driver may be fatigued due to working long hours.
- A bus driver may have failed to check their blind spots.
- A bus driver may have made an unsafe left turn.
Bus companies are considered common carriers. They must exercise a great deal of caution to avoid hitting pedestrians. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property].” Among other things, bus drivers must undergo specialized training to be able to handle their vehicle safely.
When a bus driver is negligent and hits a pedestrian, their employer could potentially be held at fault. The institution that operated a bus could be a municipal entity or a private business. In general, employers are liable for the negligent actions of their workers – insofar as those workers were operating within the course and scope of their job duties. Victims of bus accidents tend to suffer very serious injuries.
- Broken bones
- Head trauma
- Lacerations
- Spinal cord injuries
The vast majority of bus accidents are preventable. They tend to occur when bus drivers fail to check their blind spots. Blind spots are different on buses than traditional vehicles. Bus drivers typically have to rock back and forth to see everything. But far too often this does not take place, and it is innocent pedestrians that pay the price for that negligence. Any person injured in a bus accident may be able to seek justice through a bodily injury claim.
