Liability for Los Angeles Pedestrian Accidents
Every job in California must operate with the care necessary to avoid hitting any pedestrian. To that end, they must maintain their vehicle at a safe speed at all times. Pursuant to California Vehicle Code 21954, drivers must yield the right-of-way to any pedestrian crossing at a marked crosswalk. Even if a pedestrian is outside of a marked crosswalk, this does not relieve a driver of their duty of care to slow down to avoid the pedestrian. There are several factors that could contribute to any pedestrian collision.
- Speeding: Drivers are substantially more likely to be involved in pedestrian accidents if they’re speeding.
- Distracted Driving: Many pedestrian accidents involve a driver that is distracted by their phone or some other object.
- Driver Intoxication: A substantial portion of pedestrian collisions involve drivers that are operating their vehicle under the influence of drugs or alcohol.
- Vehicle System Failures: It is also possible that a vehicle system failure could contribute to a pedestrian incident. This includes situations where the brakes on a car go out.
When a driver fails to slow down to avoid colliding with any pedestrian, this could form the basis of a negligence claim. There is a presumption of negligence on the part of any driver that enters onto a sidewalk before colliding with any pedestrian. These accidents nearly always involved drivers that were speeding, distracted, or committing some other traffic infraction. However, it is worth investigating the possibility that some issue with a vehicle may have caused a driver to lose control.
