Los Angeles Attorney Secures $600,000 Settlement for Trip-and-Fall Victim Injured on Hazardous Sidewalk

Los Angeles, California – Managing Attorney Adam Kocaj secured a $600,000 settlement for a client who sustained traumatic injuries from a trip-and-fall incident while jogging on a sidewalk next to an apartment complex in Southern California.
For at least 23 years, the property manager of the apartment complex had been aware of a large tree with overgrown roots that continually uplifted the sidewalk. Despite numerous calls to the City of Los Angeles to address the issue, the city’s attempts to patch the growing defects were unsuccessful. As a result, our client suffered serious injuries due to the hazardous sidewalk conditions.
Attorney Kocaj successfully appealed the case after a Los Angeles Superior Court Judge initially dismissed the Plaintiff’s lawsuit on an erroneous finding that any defects in the sidewalk’s condition were at most trivial and not dangerous. The California Second Appellate District Court overturned this ruling, allowing the Plaintiff to continue her action and ultimately recover a combined $600,000 from the Defendant City and the adjacent property owner.
