Samer Habbas Settles a Freeway Truck Accident Claim Involving a Third-Party for $1,003,163.44

Samer HabbasRancho Cucamonga, Calif. — Managing Partner, Samer Habbas of the Law Offices of Samer Habbas & Associates secured a $1,003,163.44 settlement on a truck accident claim. A company truck was driving on the freeway when they made an abrupt and unsafe lane change, to which they hit an oncoming vehicle. The force of the impact then caused the company truck to spiral out of control and collide into the driver side of the claimant. 

The plaintiff reported to the nearest Emergency Room with immediate complaints of mid-to-lower back pain, along with pain in his left shoulder, neck and leg. The claimant was diagnosed with multiple disk herniations on his left side, mechanical lower back pain and an endplate fracture. Due to the extent of his injuries, it was advised by a specialist that he proceed with a single level lumbar fusion surgery to the L5-S1. 

Habbas made claims against both parties. Habbas was able to successfully obtain one driver’s policy limits of $25,000. Habbas simultaneously pursued the company vehicle, which had a combined single policy limits of $1,000,000 with Farmers Insurance. After it made payouts to property damage, the remaining policy limits were $978,163.44. Habbas made a demand for the remaining policy limits. Initially the Defense offered $350,000. The offer was rejected. Habbas remained firm, not willing to accept anything below the policy limits. Throughout the litigation, Farmers made several attempts to settle at the following amounts: $550,000; $700,000; and $750,000. Habbas would not give any ground. Ultimately, Farmers gave in due to Habbas’ aggressive representation and tendered its policy limits—for a total settlement of $1,003,163.44.
