Samer Habbas settles a Rear-End Car Accident Claim for $925,000

Chino, Calif.Managing Partner, Samer Habbas of the Law Offices of Samer Habbas & Associates secures a $925,000 settlement following a rear-end collision. The claimant was stopped at a red light when they were struck by the vehicle traveling directly behind them. The defendant was a car salesman delivering a vehicle on behalf of their employer Hyundai of Ontario.  

The defendant immediately classified this as a low-impact collision that could not cause harm to the occupant of the GMC Yukon that our client was operating.

The claimant made immediate complaints of lower back pain. They had a long history of chronic back pain that stretched over 20 years.

Prior to the collision, the claimant had been regularly obtaining pain management treatment. The low-speed impact, very minimal property damage, and the back history of the claimant provided several challenges that had to be overcome.  

Ultimately, in the course of the litigation, the claimant underwent back surgery. The defendant refused to acknowledge the relationship of the back surgery to the subject rear-end collision and continuously argued that it was related to their prior severe degenerative condition.  

Attorney Habbas filed suit against the car dealership, its owner, and the driver.  Immediately out the gate, this matter required extensive litigation as the defense was not being forthcoming with their discovery responses and at times being non-responsive, including missing critical depositions. Several motions had to be filed against the defendant that would eventually pave the way to obtain our client a significant settlement.  

Defendant initially made an offer of $50,000.00 to resolve this matter. The claim continued past mediation as Habbas declined every low-ball offer from the defense. He refused to settle for anything less than what our client deserved. 

With heavy law and motion, along with Habbas’ persistent negotiation, the case was resolved for $925,000.00, an amount well above the initial offer of $50,000.00 and the last offer made at mediation.
