Samer Habbas Secures a $400,000 Settlement for a Client Involved in a Head-on Collision

Chino, CA- Managing Partner Samer Habbas secured a $400,000.00 settlement for a client who was involved in a horrific collision on the 71 Freeway in Chino, CA. Our client was on the highway driving home from his job at In N Out Burger when another vehicle had entered the highway in the opposite direction and struck him head-on. Our client was stunned by the collision and his vehicle was rendered disabled. He exited his vehicle when suddenly another car coming in the same direction and directly behind his vehicle was unable to recognize it in time and violently struck it. Fearing to be hit by that 2nd car, our client leapt out of the way just seconds before that impact. His vehicle was then engulfed in flames.Fortunately, our client was able to escape this crash without significant physical injuries. He had epidural injections to his lower back but did not require any surgery.Prior to retaining our office, our client was represented by a different attorney. He came to us after his counsel had encouraged him to accept a $185,000.00 offer. The client didn’t agree and then retained Samer Habbas. Immediately, we analyzed the file, including voluminous medical records. After speaking to the client and reviewing the records, we identified that the client was suffering from psychological injuries that were not medically assessed.

Due to our representation, the client received the care he needed to become mentally better. We then rejected the $185,000.00 offer and were able to settle the case at mediation for $400,000.00 against both defendants.

Although the 2nd vehicle struck the client’s vehicle while he was not in it and made no contact with him, we were able to get them to pay $50,000.00 of the settlement despite them denying any responsibility for years.

The takeaway from this case is that not every injury is physical and that it does not always require you to be in the vehicle or physically struck to obtain damages.
