Tesla Recalls Cybertrucks After Learning That The Accelerator Can Become Stuck In The Interior Trim Above the Pedal

car accidentFREMONT, CALIFORNIA (April 23, 2024) – Electric car manufacturer Tesla has issued a recall on its Cybertruck after learning that the accelerator pedal on the vehicle can inadvertently become stuck.

According to Tesla’s recall bulletin, “On affected Cybertruck vehicles, when a high amount of force is applied to the accelerator pedal pad, the pad may dislodge and become trapped in the interior trim above the pedal.”

The recall affects nearly 4,000 Cybertrucks sold. It has also caused Tesla to cease deliveries until the required repairs have been made.

There has been at least one owner who has reported having his Cybertruck accelerator pedal get stuck while he was driving. It remains unknown if the faulty accelerator on the Cybertruck has led to any accidents thus far.

Tesla says that it has found a solution to the problem by drilling a hole in the pedal and installing a rivet.

Liability For Car Accidents Involving Stuck Accelerators

Accidents involving stuck accelerators may seem like freak occurrences, but they are actually quite common. Many of these accidents have involved Toyota vehicles. According to CBS News, “The National Highway Traffic Safety Administration said that from 2000 to mid-May, it had received more than 6,200 complaints involving sudden acceleration in Toyota vehicles. The reports include 89 deaths and 57 injuries over the same period.” Car companies should take a number of measures in order to prevent accidents involving stuck accelerators.

  • Design and Engineering: Car companies should create vehicles with fail-safe systems that prevent unintended acceleration. This can include brake override systems.
  • Quality Control: Car companies should ensure that all components related to acceleration are designed, manufactured, and installed correctly.
  • Testing and Validation: Car companies should identify and address potential issues related to acceleration. This necessitates that they perform regular testing in controlled settings and in real-world locations.
  • Recall and Repair: Car companies should quickly recall and repair vehicles that are known to have faulty components.

Depending on the facts of the case, a car manufacturer such as Tesla could face civil liability for an accident involving one of their vehicles. Car manufacturers have a legal obligation to create products that are reasonably safe. They must also warn about the non-obvious dangers associated with the use of their products. If a car manufacturer creates a vehicle with a faulty accelerator, this could form the basis of a strict liability claim. There are a number of steps that should be taken after any Tesla accident involving a stuck accelerator.

  • A police report of the accident should be created.
  • Surveillance footage of the collision should be sought.
  • A thorough diagnostic of the vehicle involved should be undertaken.
  • An experienced Orange County auto accident attorney should be contacted.

It can be hard to know what to do after a car accident. Victims are often left with high medical bills and may need to take extensive periods of time off of work. These problems are often exasperated when a collision is due to a vehicle system failure. Car companies like Toyota and Tesla have demonstrated time and time again that they will do everything in their power to deny liability if their vehicles are involved in a collision. This is why it is important to seek the skilled legal advice of a personal injury attorney after any collision.
