California’s Social Host Liability Law

In California, as per the Business and Professions Code Section 25602.1, a social host can be held liable if they knowingly provide alcohol to a minor who subsequently causes injury to another as a result of intoxication. However, for adults, California doesn’t broadly impose liability on social hosts unless they charge for the alcohol.

So, it’s important to distinguish between the liability of commercial establishments (bars, clubs, etc.) and that of private hosts. While commercial establishments may be held liable for serving alcohol to obviously intoxicated patrons, private hosts usually aren’t held to the same standards unless they’re selling alcohol at their party.
