Liability for Half Moon Bay Truck Accidents
Truck drivers are supposed to operate with an abundance of caution to avoid car accidents. Many of these collisions involve truck drivers that make dangerous lane changes. According to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.” Multiple factors could contribute to any truck accident.
- Truck accidents are much more likely to occur during periods of inclement weather.
- Truck accidents are more likely to occur if one or more vehicles are speeding.
- Truck accidents are more likely to occur during periods of stop-and-go traffic.
- Truck accidents are more likely to occur if a truck driver is not well rested before their shift.
If a truck driver fails to slow down or use caution to avoid collisions with smaller vehicles, this could be considered negligence. Depending on any specific case, there may be multiple liable parties. This includes the company that a truck driver was working for. Employers can be held vicariously liable for the wrongful actions of their workers who are operating within the course and scope of their job duties.
Steps to Take After Half Moon Bay Truck Accidents
Many people are seriously injured or killed every year in preventable truck accidents. According to the FMCSA, “In 2022, 347 of the 5,760 large truck drivers in fatal crashes (6 percent) tested positive for at least one drug, although 58 percent of them were not tested.” Multiple steps should be taken after any truck accident.
- Police Report: The police report created after the accident should be examined. These reports can be helpful, but they can also contain inaccuracies.
- Photos: Lots of photos of the accident site should be taken. Even a photo can help reveal what may have led up to a crash.
- Independent Review: The family of any person who died in a truck accident should carefully consider their options with a team experienced in injury claims.
Truck accidents can be absolutely devastating for those in smaller vehicles. Pedestrians and motorcyclists are particularly at risk. Unfortunately, truck drivers and their insurance providers will virtually never accept responsibility if they are involved in a fatal collision. They’re more likely to blame the victim. This is why it is so important that these accidents are thoroughly investigated by an outside party.
