Samer Habbas increases an initial offer of $4,350 to $705,000 from a Rear-End Accident with an Underinsured Motorist

habbasLos Angeles, Calif. Managing Partner, Samer Habbas of the Law Offices of Samer Habbas & Associates secures $705,000 from a rear-end collision involving an underinsured motorist (UIM). The claimant was a backseat passenger when the car traveling behind them rear-ended the vehicle. The impact of the collision caused the claimant’s vehicle to be pushed forward and crash into the vehicle directly in front of them and resulted in a 4 car crash.  

The defendant was traveling at an unsafe speed for road conditions, leaving them no time to break for traffic ahead. Based on the statements from the parties involved and physical evidence at the scene, it was clear the defendant was at fault and the sole cause of the accident.

The claimant sustained multiple injuries from the accident, mainly to his lumbar spine. The defense argued that the low-speed impact did not cause the Claimant’s alleged injuries. In response, they submitted an initial offer of $4,350. Managing Partner, Samer Habbas then filed a lawsuit against the negligent party and sought the policy limits of $250,000. Despite their unjustifiable low-ball offer, State Farm caved in and accepted Habbas’ policy limits demand for $250,000. But Habbas didn’t stop there.   

Our client’s damages far exceeded the defendant’s policy limits. Habbas was determined to recover every cent our client was owed. Once Habbas settled the matter with the defendant for full policy limits, he moved to secure the remaining funds through the underinsured motorist (UIM) policy, covered by his client’s insurance carrier. After Habbas demanded arbitration, the insurance company promptly hired counsel and increased their offer to $455,000—for a global settlement of $705,000.
