$750,000 Settlement Recovered For a Pedestrian Hit by a MiniBus

Managing Partner Samer Habbas secured a settlement in the amount of $750,000.00 for a client who suffered shoulder and rib injuries when struck by a minibus in Daly City, located in the San Francisco Bay Area.  Our client was in Northern California for work.  He was crossing the street at night time using a marked crosswalk.  The bus driver did not see him and struck him.

Shortly after the collision, our client retained legal counsel.  Unhappy with those services, he retained our legal team to represent him.  We took over the matter and seamlessly continued his representation.  We quickly initiated an investigation into the case facts.  It was determined that the defendant driver was within the course and scope of his employment with his employer at the time of the crash.  Through discovery in the litigation stage, we had learned that the defendant had a shortage of drivers and had required their drivers to work extensive hours throughout the day.

Our client underwent shoulder surgery as a result of a shoulder tear he suffered in the crash.  When our client first retained our services, he had been struggling in obtaining the necessary medical care to help him heal from his injuries.  As part of our services, we helped coordinate him with reputable orthopedic surgeons to choose from that would work on a lien basis.  By having his bills on a lien, the client did not immediately go out of pocket as the medical providers would wait until case resolution to be paid for their services.

After filing suit on this case, the Court required that the parties attend mediation.  When the Court mandates mediation, the parties have no choice but to present in front of a mediator.  As directed by the Court, we attended mediation.  However, we knew that the defendant was not going to come anywhere near providing our client with just resolution.  Rather than entertain low ball offers and leverage our position, we immediately walked out of mediation without exchanging any offers other than our initial starting one.  The defendant knew we were serious and will go to trial and then reached out to us afterwards and settled the case for $750,000.00, which is an exceptional result of this case.
