Multiple paramedics and first responders were called to the scene of the collision to help all of the victims. One photo of the accident site showed major front-end damage to the bus involved.

It remains unclear if the bus driver will face any citations for the crash.
Liability for Encinitas Semi-Truck Accidents
California law requires that common carriers operate with an abundance of caution to avoid causing harm to their passengers. According to Acosta v. Southern California Rapid Transit Dist., “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a very cautious person towards their passengers. Such carriers are responsible for any, even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.” There are many ways that a bus driver may have acted negligently prior to any collision.
- A bus driver may have been traveling at an unsafe speed for the prevailing conditions.
- A bus driver may have been following the lead vehicle too closely.
- A bus driver may have been preoccupied with their cellphone or conversations with passengers.
- A bus driver may not have taken rest breaks as required by law.
Under California law, drivers are required to maintain adequate separation with other vehicles ahead of them. Pursuant to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.” Liability for any bus collision could extend beyond any one driver determined to be at fault. The company that a bus driver worked for could be vicariously liable if the bus was being used for some type of commercial purpose at the time of the crash.
Steps to Take After San Diego County Tour Bus Crashes
Buses are typically very safe for their passengers. But bus accidents can still result in very serious injuries or death if the vehicles involved are traveling at freeway speeds. According to The Journalist’s Resource, “about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” Victims of bus accidents should take a number of measures to protect their legal rights.
- Treatment: Victims should seek treatment as early as possible. Many of the injuries associated with major collisions will not be immediately obvious.
- Police Report: The police report created after the collision should be collected and reviewed.
- Evidence Preservation: All of the physical evidence associated with the collision should be preserved.
- Legal Review: Accident victims should consider all of their legal options with an experienced bus accident attorney.
There is a tremendous peace of mind that can come with having an experienced attorney handle your legal claim. They can do all of the work to ensure that your interests are taken into consideration. You also don’t owe them any money upfront. Bus accident attorneys work entirely on a contingency fee basis. This means they only get paid if they were able to successfully resolve your case. Any person injured due to the negligent actions of a tour bus driver may be able to seek some measure of accountability through a civil claim.
