The problem of insurance companies acting in bad faith or breaching the terms of the contracts they write became so widespread that state legislators wrote Insurance Code 790.03(h) some years back, otherwise known as the Unfair Practices Act. The Act prohibits insurance companies from engaging in many different acts to mislead, defraud or otherwise avoid paying legitimate insurance claims.   • Failing to acknowledge and react within a reasonable period of time to clients’ questions about insurance claims
  • Purposely misrepresenting the facts of a client’s case or coverage included in his or her policy

  • Failing to affirm or deny a claim within a reasonable period of time after a claimant has completed and submitted proof of loss requirements

Attempting to settle a claim by a policyholder for less than the amount to which a reasonable person would have believed he or she was entitled by reference to written or printed advertising material accompanying or made part of an application

Directly advising a claimant to not seek the services of an attorney
